Terms of Service

By accessing or using OrderFlow AI (the “Service”), you agree to these Terms on behalf of yourself and any organization you represent. If you do not agree, do not use the Service.

OrderFlow AI provides AI-powered phone answering for restaurants, including real-time order capture, menu Q&A, modifier confirmation, and kitchen routing. Features vary by subscription plan.

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. We will not discontinue the Service without providing at least 30 days’ notice to active subscribers.

• You must be at least 18 years old and authorized to bind your business to these Terms.
• You are responsible for maintaining the security of your account credentials.
• You must provide accurate information during onboarding. False information may result in account termination.

• Subscriptions are billed monthly in advance. Prices are listed on the Pricing page and may change with 30 days’ notice.
• The Local Café plan: $30/month. The Busy Pizzeria plan: $99/month. Enterprise: custom.
• You may cancel at any time. Cancellation takes effect at the end of the current billing period — no prorated refunds.
• Failed payments may result in service suspension after a 7-day grace period.

You agree not to:

• Use the Service for any purpose other than legitimate restaurant order management.
• Attempt to reverse-engineer, scrape, or extract proprietary AI models or prompts.
• Use the Service to record calls without the caller’s knowledge where legally required.
• Introduce malware, spam, or automated abuse into the system.
• Resell or white-label the Service without a written reseller agreement.

The Service records and transcribes phone calls to process orders. You are responsible for compliance with applicable wiretapping and call recording laws in your jurisdiction (e.g., two-party consent states). OrderFlow AI provides a configurable disclosure prompt at the start of each call — enabling this is your responsibility.

Your use of the Service is subject to our Privacy Policy, which is incorporated here by reference. You retain ownership of your restaurant data and customer data. You grant us a limited license to process that data solely to provide the Service.

OrderFlow AI and its licensors own all rights to the platform, AI models, software, and branding. These Terms do not transfer any ownership to you. You may not copy, modify, or create derivative works of any part of the Service.

THE SERVICE IS PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI ORDER CAPTURE IS NOT PERFECT — YOU REMAIN RESPONSIBLE FOR VERIFYING ORDERS BEFORE FULFILLMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ORDERFLOW AI’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE FEES YOU PAID IN THE THREE MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR LOST PROFITS, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

You agree to indemnify and hold harmless OrderFlow AI, its officers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles. Disputes shall be resolved in the state or federal courts of Fulton County, Georgia. You waive any objection to such jurisdiction.

We may update these Terms with 14 days’ email notice to active subscribers. Continued use after the effective date constitutes acceptance.
